Abstrakt

The article addresses the issue of the limitation of claims for damages arising out of injury suffered by a foetus and a minor child caused by a tort. In the first part of the text, the analysis focuses on claims for damages resulting from a tort that caused an injury to an unborn foetus. The deliberations concerning the foetus? legal status are used to present the hypothetical consequences of adopting the particular positions presented in the text for the determination of the inception and running of the limitation period applicable to such claims for damages. Thereafter, these remarks are applied to regulations currently in force in Art. 4461 of the Civil Code. Further on, deliberations concern the solutions applied by the legislator, which specifically address the running of the limitation period for claims for damages of minor children associated with injury arising out of a tort. Next, there follows analysis and opinion on regulations providing for delay of the commencement or end of the limitation period, or its suspension. The deliberations are then summarized with a presentation of the most important conclusions resulting from the text.
